1. Who we are

2. What this policy covers

This policy explains what happens to personal information you provide through this website, or that is collected automatically while you use it.

It does not cover the separate contractual arrangements that govern a professional engagement with us. If you retain us, the handling of case materials, evidence and confidential information is governed by the engagement documents for that matter, not by this policy.

3. Information you give us

We collect information you type into forms on this site. There are three.

The enquiry form, which appears on most pages. It asks for your first name, last name, email address, telephone number, company or firm, a description of what you need, the role you hold, and the subject area of your enquiry. Every field except the last two is required in order to submit it.

The newsletter sign-up, which asks only for your email address.

The event registration form, which asks for your name, email address, company or firm and role, and lets you opt in to the newsletter at the same time.

We also record technical information that arrives with a form submission, including the page you submitted from and, where present, advertising click identifiers that tell us which advertisement or campaign brought you to the site.

4. Please do not send us privileged or confidential case material through this website

This matters more for our practice than it would for most businesses, so we are saying it plainly.

The enquiry form is a general intake channel. It is not a secure or privileged channel, submissions are delivered by email to more than one member of our team, and sending us information does not create any attorney work product protection, expert consulting privilege, or confidential relationship of any kind.

We will treat what you do send with care, but the safest handling of sensitive material is not to send it through a web form in the first place.

5. Information collected automatically

Like most websites, this one collects some information about your visit automatically, through cookies and similar technologies. That includes the pages you view, the approximate location implied by your network address, the browser and device you use, how you arrived at the site, and how you interact with pages.

One of the tools we use, Microsoft Clarity, records session replays and aggregate heatmaps so that we can see where visitors struggle with the site. It is configured to mask what you type into form fields, so the contents of your enquiry do not appear in a recording.

Section 8 lists every one of these technologies by name.

6. Why we use your information, and our legal bases

We use what you give us to respond to your enquiry, to assess whether we are the right firm for your matter, to arrange and hold calls and meetings, to send the newsletter if you asked for it, to register you for an event if you asked for that, and to keep our own records of enquiries we have received.

We use the automatically collected information to keep the site working, to understand which pages are useful, to measure whether our advertising is working, and to protect the site from automated abuse.

Where the law requires us to identify a legal basis for using your information, these are the bases we rely on:

• Our legitimate interests, for responding to enquiries, for keeping records of them, for being able to identify conflicts of interest, and for keeping this site secure.
• Performance of a contract, once you retain us.
• Your consent, for the newsletter. You can withdraw it at any time, and withdrawing it does not affect anything we did before you withdrew it.

7. Who we share it with

We do not sell your personal information, and we do not share it with anyone for their own marketing.

We do use service providers who process information on our behalf. The ones that operate on this website are:

• HubSpot, which provides our forms, our customer records, our email, our meeting scheduler and part of our site analytics. Everything you submit through a form on this site is stored in HubSpot.
• Google, which provides our tag management, our site analytics and our advertising measurement. This includes Google Analytics, Google Ads and DoubleClick. It also includes Google Ads call tracking, which is able to replace the telephone number shown on a page with a Google forwarding number so that a call can be attributed to the advertisement that brought you here.
• Microsoft, through the Clarity product, which provides session replay and heatmaps, with form entries masked.
• Vimeo, which serves embedded video on some pages and sets its own cookies when a player loads.
• Cloudflare, which hosts and delivers this website and protects it from attack.

We may also disclose information where we are required to do so by law, by a court, or in connection with legal proceedings, and to our professional advisers where necessary.

8. Cookies and similar technologies

These are the cookies and local storage items this site sets. Names can change when a provider updates its product.

We do not currently show a cookie banner, and the analytics and advertising cookies above are set when you arrive. We are working to add a consent mechanism. In the meantime you can control these in three ways: block or delete cookies in your browser settings, install Google's Analytics opt-out browser add-on, or change your Google advertising settings. Blocking them does not affect your ability to use this site or to contact us.

9. Where your information is processed

We are based in the United States, and our service providers process information in the United States. If you contact us from outside the United States, including from the United Kingdom or the European Economic Area, your information will be transferred to the United States.

Where that transfer is subject to United Kingdom or European Union data protection law, we rely on the safeguards our service providers have put in place for international transfers, including standard contractual clauses and, where applicable, the EU-US and UK-US data privacy frameworks.

10. How long we keep it

How long we keep information depends on what it is.

Enquiries that do not become an engagement. We keep your enquiry and our correspondence about it for three years from our last contact with you, and then delete it.

A minimal conflicts record, kept indefinitely. After the three years above, we retain only the names of the parties involved and a matter reference, and nothing else. We do this because, as expert witnesses, we may need to establish years later whether we were previously approached about a matter or by an opposing party. We cannot meet that obligation if we delete every trace of an enquiry.

Newsletter. We keep your email address until you unsubscribe. After you unsubscribe we keep your address on a suppression list, so that we do not email you again by mistake.

Event registrations. We keep these for twelve months after the event.

Information about an engagement. Governed by the engagement documents for that matter, not by this policy.

11. Your rights

Depending on where you live, you may have the right to ask us for a copy of the personal information we hold about you, to have it corrected, to have it deleted, to object to or restrict how we use it, to withdraw a consent you previously gave, and to receive it in a portable form.

If you are in the United Kingdom or the European Union, you also have the right to complain to your data protection authority.

If you are a California resident, you have the right to know what personal information we collect and how we use it, the right to ask us to delete it, and the right not to be discriminated against for exercising those rights. We do not sell personal information.

You can unsubscribe from our newsletter at any time using the link in any newsletter we send.

To exercise any of these rights, contact us at [email protected], or use our contact form. We will respond within the time the applicable law allows, and we may need to verify who you are before we act.

If you are making a request about your own information, you do not need to give us any more detail than we need in order to identify you and act on it.

Please note the minimal conflicts record described in section 10. Where we are required to keep that record in order to identify future conflicts of interest, we may not be able to delete it in full, and we will tell you if that applies to your request.

12. Security

We use reputable providers, we serve this entire website over an encrypted connection, and we limit access to enquiry records to the people who need it. No method of transmission over the internet is completely secure, which is the practical reason for the request in section 4.

13. Children

This website is intended for professional and business use. It is not directed at children, and we do not knowingly collect personal information from anyone under the age of 16. If you believe a child has provided us with information, contact us and we will delete it.

14. Changes to this policy

We may update this policy. When we do, we will change the date at the top. If a change materially affects how we use information you have already given us, we will take reasonable steps to tell you.
